As any experienced product liability attorney can attest, any product can be dangerous in the right circumstances. However, some products are notorious for causing personal injury to consumers and users. Read on for information on some of the most dangerous products in America.
Trampolines
According to 2012 estimates from the US Consumer Product Safety Commission (CPSC), there were 94,900 hospital emergency room injuries involving trampolines. Between 2000 and 2009, twenty-two deaths were also noted by the CPSC.
The design and intended use of trampolines makes them inherently dangerous. Therefore, many trampoline manufacturers ensure that their product comes with ample warning labels that clearly state the safest way to use the trampoline. Often, cases of personal injury that result from trampolines are cause of user error or negligence, such as having too many individuals on the trampoline at one time.
All-Terrain Vehicles (ATVs)
According to the CPSC, there were 1,697 deaths stemming from all-terrain vehicle (ATV) accidents in the three-year period between 2015 through 2017. ATVs are notoriously dangerous vehicles that are prone to causing personal injury for a number of reasons. For one, there are no safety belts or harnesses of any kind. The steering and chassis of typical ATVs means these vehicles allow riders to make abrupt turns at high speeds. For untrained riders, the momentum shift can cause them to be ejected from the vehicle at high speed.
As with trampolines, an attempt to bring a product liability lawsuit against the manufacturer of an ATV would need to show that the vehicle’s safety warnings were insufficient. Because many of the major manufacturers of ATVs have taken strong precautions to ensure the dangerous nature of their vehicles is known to consumers, winning litigation can be challenging. Consulting with a product liability attorney is strongly recommended.
Toxic Chemicals
According to data from the US Bureau of Labor Statistics, in 2017 there were 41 fatal work injuries related to the exposure to toxic chemicals and products. The manufacturers of these chemicals take precautions to ensure their products are properly labeled with regards to safe use, storage, and management after exposure.
Types of Product Liability Cases
As any experienced product liability attorney can attest, there are three main grounds under which an individual can file a lawsuit that concerns a defective product:
- Defective manufacturing. If there was a mistake made either at the manufacturing facility or at some point between the facility and the point of purchase, manufacturers may be liable for any subsequent personal injury to consumers that results.
- Defective design. If the product design is dangerous in some way despite correct manufacturing, consumers injured by the product may have grounds for litigation.
- Failure to warn. Product designers and manufacturers have a duty to warn consumers of any threats to the safety that may result from the proper or improper use of the product. If warnings are not present or insufficiently comprehensive, those injured as a result should contact an experienced local product liability attorney to discuss litigation.
