Nevada law enforcement was called to the site of a car accident in Carson City that resulted in several victims suffering injuries, according to news reports. Each year, more than 22,000 people are hurt in life-changing car accidents across Nevada. Oftentimes these collisions force victims to suffer long-term disabilities due to their injuries.
The Accident
On May 12, just before 6:40am emergency crews were called to the scene of the crash on East Williams Street and North Saliman Road. Carson City Fire Department reported that a crash between two vehicles caused one car to roll over. Authorities further noted that one juvenile child and two adults were injured in the crash. The drivers in the crash were both adults. All three victims were transported to a local area hospital for medical treatment. The investigation remains under investigation.
Common Injuries
When someone is involved in a crash, an experienced Las Vegas accident attorney will likely advise a victim to go to the emergency room or their treating doctor to treat any injuries. While it is not unusual for some accident victims to think they are uninjured because of a delay in the onset of symptoms, medical treatment should not be delayed.
The most common Nevada car accident injuries include:
- Head injuries;
- Internal injuries;
- Soft tissue injuries;
- Broken bones;
- Whiplash; and
- Psychological injuries.
Seeking medical care for injuries — no matter how minor they may seem — is critical not only to a possible personal injury lawsuit but also to your recovery from the crash. Be sure to seek treatment regularly, follow your doctors’ orders, and keep records.
Damages Available
Under Nevada law, car accident victims have the right to recover monetary compensation from another party if that party’s reckless or negligent actions caused the accident. An accident victim can seek damages whether the injured party was a passenger or a driver. An injured party may be entitled to payment for the following:
- Medical costs;
- Lost wages;
- Loss of earning capacity;
- Occupational and/or physical therapy;
- Court costs; and
- Pain and suffering.
Nevada law allows for accident victims to seek compensatory damages for past and future losses in personal injury claims. Compensatory damages are economic and non-economic. Economic damages can be easily put into dollar amounts, while non-economic damages do not necessarily include out-of-pocket expenses. Punitive damages, on the other hand, are not meant to compensate a victim’s losses but instead to punish wrongdoers for bad behavior.
In most situations and types of cases, there is not a limit on the amount an accident victim can recover as compensatory damages in Nevada. Compensatory damages may be awarded in the amount a jury or judge deems reasonable and fair. The exception to an unlimited amount of damages is in medical malpractice lawsuits, where monetary compensation is capped at $350,000 no matter how serious the pain and suffering a victim experiences.
