A Las Vegas man has filed a $10 million lawsuit against Alvin Kamara after an assault and battery left the man with “disfiguring injuries” according to a recent lawsuit. Kamara is also facing charges over the incident. Prosecutors claim that Kamara struck the man at least three times after he had fallen to the ground and later bragged about the altercation.
The plaintiff claims there was no justifiable provocation involved in the assault. He states that he was attempting to enter an elevator, but Kamara attempted to block his path by putting his arm across his chest. This led to an altercation that left the plaintiff severely injured. The man claims he suffered a concussion and was left unconscious by the beating. At one point, the victim says he attempted to flee Kamara but was prevented from doing so. Surveillance video captured the beating on film.
Assault and Battery Torts
Can you sue someone for beating you up? The answer is absolutely yes. In most cases, provocation will be an element of the defense, however.
Negligent Security Torts
It is fair to ask whether the venue is also responsible for this man’s injuries. While venues are responsible for ensuring the safety of their guest, their duty of care only extends so far. No venue, no matter how well secured, will be able to prevent every assault that occurs on the property. Plaintiffs who want to sue venues for negligent security must establish that the injury was preventable.
