In today’s ‘Is It Legal?” we’ll dispel that rumor and tell you how you CAN buy cigarettes online. There is no Federal law that prohibits internet sales of tobacco products (although this September the FDA announced a crack down on the online sales of e-cigarettes to minors).
As a consumer, you can purchase packs or cartons online, BUT according to the Alcohol and Tobacco Tax and Trade Bureau (TTB) you are not exempt from paying Federal excise tax or customs duties on products purchases from outside the U.S.
If purchasing from outside your home state, you may also be liable for any cigarette excise and/or sales tax. Here are Nevada’s state sales and use taxes. In the Silver State, as per NRS 370, the excise tax charged on tobacco products is $1.80 or $2.25 per pack, depending on the size.
There you have it; if you’re a smoker and of age, you can legally purchase your tobacco online. Just be sure to pay any applicable taxes and you’re in the clear. What do you think, should it be legal?
