Acting on Behalf of Injured Plasma Donors
The client who turned to H&P Law for legal support reported that in July 2020, in the midst of the COVID-19 pandemic, he donated plasma through BioLife Plasma Services, LP. After doing so, he suffered permanent nerve damage, resulting in the paralysis of his left arm at the age of 21.
An investigation into BioLife’s practices led the H&P Law team to believe that BioLife was not providing its staff with the appropriate training. The company was even hiring and retaining employees who had no experience working in the medical industry.
These parties did not know how to properly identify a vein to pull plasma from or safely collect plasma, nor did they understand the risks of choosing the wrong vein and inappropriately drawing plasma from a donor’s body.
Challenging Biolife’s Defenses
BioLife began insisting that the plaintiff with H&P Law did not suffer any adverse effects while under its care from the moment Attorneys Brooks and Pfau filed a claim against the company.
The company claimed that because the client signed a waiver before donating plasma, Biolife did not assume any liability for their nerve damage and paralysis.
BioLife’s employees went on to claim that they had no memory of interacting with H&P Law’s client, attempting to discredit his testimony. In reality, an investigation into BioLife’s conduct and the behavior of its employees divulged the reality of the client’s injuries and the conditions that caused them.
That same investigation led the jury involved in the case to state that BioLife’s waiver did not address BioLife’s failure to invest in employee training and safe, industry-vetted medical practices.
Securing the Plaintiff’s Settlement
Proving that BioLife had to take responsibility for its employees’ conduct and the client’s injuries, H&P Law secured a six-figure settlement on that client’s behalf.
That settlement, which exceeds $477,000 in value, cannot make up for the client’s five years of suffering or restore his mobility. However, it can relieve his financial suffering and prevent BioLife from causing similar damage to future donors.
