A car accident that occurred in the Whitney area of Nevada resulted in injuries for those involved, according to local law enforcement. At the end of April this year, emergency crews were informed that a vehicle crash occurred on East Russell Road and Boulder Highway. Las Vegas Metropolitan Police Department (LVMPD) reported that the crash between the cars happened just before 11am at the intersection of East Russell Road and Boulder Highway. The crash caused some stop-and-go traffic while firefighters were assisted by LVMPD with clearing out the crash site. The accident remains under investigation at this time.
According to Channel 3 News, the number of car accident deaths increased by 3.3% for 2019 to 2020 despite a decrease in traffic and the number of deaths in March and May according to the Nevada Office of Traffic Safety (NOTS).
Nevada Accidents
Each year over 20,000 people suffer debilitating injuries in Nevada as a result of car accidents. While there are several things that Nevada drivers can implement before going out on the roadways to stay safe, there really is no way to predict or control the behaviors of other drivers. Unfortunately, many are involved in serious and even devastating car accidents. The majority of Nevada car accidents are the result of reckless and careless motorists who are on its roadways. Common injuries suffered in a car accident include:
- Whiplash;
- Cuts and scrapes;
- Head injuries;
- Broken bones;
- Herniated discs;
- Internal bleeding;
- Knee trauma; and
- Post-traumatic stress disorder;
Harm suffered in a Nevada accident can differ depending on the circumstances of the crash. While injuries can range from minor to severe, it is always important for crash victims to seek medical attention right away.
Damages Available
Nevada law, like the law of most states across the nation, allows for accident victims to seek monetary compensation for harm suffered as a result of a crash that was due to the fault of another. Compensatory damages include economic and non-economic damages. Economic damages include those that can be calculated easily into a dollar amount. They include things such as property damage, medical bills, lost past wages, and lost earning capacity. Non-economic damages, on the other hand, do not necessarily involve out-of-pocket expenses that the accident victim incurred. Instead, they include things such as emotional distress, pain and suffering, physical impairment, inconvenience, disfigurement, loss of enjoyment of life, and other general losses.
In most situations, there is no limit on the amount that an accident victim can recover in compensatory damages. Simply put, these types of damages can be awarded in the amount determined by a jury or bench trial, presuming the case goes to trial. There is an exception to this unlimited amount when it comes to non-economic damages, however. In medical malpractice cases, the maximum amount of monetary compensation that can be awarded is $350,000 regardless of the extent of pain and suffering or the economic damages suffered by a victim.
