What to Do After a Taxi Accident

Under Nevada law, personal injury victims are allowed to seek “economic” and “non-economic” damages for harm suffered. State law also allows for punitive damages, but under NRS 42.005 these damages are generally capped or limited, with some exceptions, to:
- $300,000 if the amount of compensatory damages awarded is less than $100,000; or
- Three times the amount of compensatory damages if the award is more than $100,000.
Economic damages include those monetary losses that are incurred as a result of the injuries. These include:
- Loss of earnings (past or future);
- Medical expenses (past or future);
- Loss of business opportunities (past or future); and
- Cost of replacement or repair of damaged property.
Non-economic damages include those losses that are not easily quantified by a specific monetary amount. These include:
- Pain and suffering;
- Physical impairment;
- Loss of consortium;
- Mental health issues; and
- Loss of enjoyment of life.
Notably, a physical injury is not required under Nevada law in order to recover damages for pain and suffering resulting from a taxi accident.
