Every year there are over 50,000 traffic accidents in Nevada. About 27,000 people are injured every year in these traffic accidents—an average of 74 every day. In 2014, 1,209 people suffered serious injuries from traffic accidents, and 291 people lost their lives.
Although accident-related injuries have been on a downward trend for the last few years, there are still tens of thousands of accidents and injuries every year occurring to real people with real lives. As Henderson accident attorneys, we work to make sure you get the compensation necessary to pay for medical treatment and other losses.
If you are injured in a traffic accident, your job is to get competent medical treatment, take care of yourself, and do what you can to recuperate. It is the accident attorney’s job to work with the insurance company, the insurance company’s counsel, and the courts, if necessary, to make sure your medical bills are paid for, you are reimbursed for time off work, your pain and suffering, and any other compensable losses you incur as a result of the accident. A good traffic accident lawyer will help you itemize your losses and help identify and quantify your damages.
To maximize recovery, it is our job as your accident attorney to make the strongest case possible regarding (1) liability, and (2) damages.
“Liability” is a fancy way for accident attorneys to say “fault.” Accident lawyers like us work hard to establish that another party has breached a duty it owed to you. Often a responding police officer will prepare a traffic accident report in which he apportions fault. Although insurance companies rely on this in making their preliminary determination of liability, and it can be valuable in settlement negotiations, the conclusions of the police officer as written in the report are not admissible against you or the opposing party, so your accident attorney has to collect evidence that shows the other party is responsible for the accident without relying on the traffic accident report.
Damages refers to money correlating with your losses. As your Henderson accident attorney, we prove damages by providing medical bills, evidence that you missed work, can no longer perform household chores, and have been experiencing pain, suffering, and/or mental anguish resulting from the accident, to name a few.
Even if you are partially at fault for the accident, as long as you are not found more than 50% at fault, you can still recover for your losses, less a reduction for your portion of the liability.
If you have been in a traffic accident, you may want to seek accident lawyer advice or ask yourself should you get a lawyer after a car accident. An accident lawyer consultation is always free at H&P Law Las Vegas, and we would be happy to give free accident legal advice. In your personal injury lawyer consultation, we will analyze the facts specific to your case and help you decide whether you need to hire an accident attorney.
As a general rule, however, if you are injured at all, you should seek out accident lawyers to make sure your rights are protected. Unfortunately, insurance companies are predictable. They will be very nice to you on the phone (usually) but try to get away with giving you far less that the amount you’ve actually lost as a result of the traffic accident, particularly if they know you don’t have an accident attorney.
If you are not injured at all (which you probably will not know for at least a couple days after the traffic accident), you probably do not need to consult with an accident attorney.
